Please read these Terms carefully before using the Cooper AI Concierge service. By signing up, completing the application, or using the service, you agree to be bound by these Terms. If you don't agree, don't use the service.
1 Service Description
Cooper AI Concierge ("Cooper," "the Service") is an AI-powered personal assistant subscription service operated by Highside Real Estate, LLC ("we," "us," "our," "Company"). Cooper provides AI-generated assistance including but not limited to document drafting, research, analysis, email support, scheduling reminders, and productivity workflows.
Important: Cooper is an AI agent service — not a licensed professional. Outputs generated by Cooper are not legal advice, medical advice, financial advice, or professional services of any kind. Do not rely on Cooper's outputs as a substitute for qualified professional counsel.
Cooper is provided on an "as-is" basis. While we work hard to maintain quality and availability, we do not guarantee uninterrupted service or that every output will be free of errors.
2 Subscription Terms
Cooper is offered as a paid subscription service. Current pricing tiers are listed on the Cooper website at the time of signup.
- Free Trial: New subscribers receive a 7-day free trial. No credit card is required to begin the trial, but a valid payment method must be on file before the trial ends to continue service.
- Billing Cycle: Subscriptions are billed monthly or annually, as selected at signup. Annual plans are billed in full at the start of each annual period.
- Auto-Renewal: Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
- Price Changes: We may change subscription prices. We will give you at least 30 days' advance notice of any price increase. Continued use after the effective date of a price change constitutes acceptance of the new price.
- Payment Processing: Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all amounts due.
3 Cancellation Policy
You may cancel your subscription at any time by emailing us at john@highside-re.com with "Cancel My Subscription" in the subject line.
- When cancellation takes effect: Cancellations take effect at the end of the current billing period. You will retain full access to the Service through the end of the period you have already paid for.
- No partial refunds: We do not provide refunds for partial months or partial annual periods. If you cancel mid-cycle, your access continues until the end of that paid period — but no refund is issued for unused time.
- Trial cancellations: If you cancel during your 7-day free trial before a payment method is charged, you owe nothing and your account is closed at trial end.
- Data after cancellation: After cancellation, your data is retained for 30 days, during which you may request an export. After 30 days, your data is permanently deleted. See Section 4 for more details.
4 Data & Privacy
We take your privacy seriously. Here's what you need to know:
- What we store: Your account information (name, email), payment records (processed by Stripe — we don't store card numbers), conversation history with Cooper, and any documents or files you share.
- Data isolation: Your data is stored in a dedicated, isolated environment. No other client can access your data. Your data is not used to train shared AI models.
- Retention: Your data is kept while your subscription is active plus 30 days following cancellation or account closure.
- Third-party processors: We use Anthropic (AI processing), Stripe (billing), Microsoft (email infrastructure), and Cloudflare (hosting). These processors are bound by their own privacy agreements and applicable law.

5 AI Disclaimer
Cooper is an AI — not a licensed professional. Outputs generated by the Service are AI-generated and may contain errors, omissions, or outdated information.
Cooper's outputs:
- Do not constitute legal advice. Consult a licensed attorney for legal matters.
- Do not constitute medical advice. Consult a licensed healthcare provider for medical decisions.
- Do not constitute financial advice. Consult a licensed financial advisor for investment or financial planning decisions.
- Do not constitute tax advice. Consult a licensed CPA or tax professional for tax matters.
You are solely responsible for evaluating the accuracy, completeness, and appropriateness of any output generated by Cooper before acting on it. We are not liable for decisions you make based on AI-generated content.
6 Acceptable Use
By using Cooper, you agree that you will not:
- Use the Service for any illegal purpose or in violation of any applicable law or regulation
- Use the Service to generate content that is fraudulent, defamatory, harassing, or harmful
- Input the personally identifiable information of third parties without their consent
- Attempt to reverse-engineer, copy, or replicate the Cooper system architecture or underlying technology
- Use the Service to create spam, misinformation, or manipulative content at scale
- Share your account access or subscription with others not authorized under your plan
- Attempt to circumvent security measures or access another user's account or data
- Use the Service in any manner that could damage, disable, or impair our infrastructure
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions, with or without prior notice, at our sole discretion.
7 Limitation of Liability
To the maximum extent permitted by applicable law, our total cumulative liability to you for any claims arising out of or related to these Terms or the Service — whether based on contract, tort, strict liability, or otherwise — shall not exceed the total subscription fees you paid us in the three (3) months immediately preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full.
8 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Post the updated Terms at this URL with a new "Last Updated" date
- Send you an email notice to the address on your account at least 30 days before the changes take effect
Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms. If you disagree with any changes, you may cancel your subscription before the effective date.
9 Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.
Before initiating any formal legal proceeding, you agree to first contact us at john@highside-re.com and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.
10 Intellectual Property
Your content: You own the content you provide to Cooper. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you.
Our content: The Cooper platform, brand, code, and documentation are proprietary to Highside Real Estate, LLC. You may not copy, reproduce, or distribute our technology or intellectual property without written permission.
AI outputs: Content generated by Cooper on your behalf is provided to you for your use. We make no copyright claim to AI-generated outputs.
11 Termination
Either party may terminate these Terms at any time. You may terminate by canceling your subscription. We may suspend or terminate your access to the Service:
- For violation of these Terms
- For non-payment after notice and a reasonable cure period
- If we discontinue the Service (we'll give at least 30 days' notice)
- For any other reason, with at least 7 days' written notice unless termination is for cause
Upon termination, your right to access the Service ceases immediately (or at the end of your paid period, as applicable). Sections 5, 7, 9, and 10 survive termination.
12 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Highside Real Estate, LLC with respect to the Cooper AI Concierge service. They supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
